Summary
You/Your Business has hired Visuals by Glenn Patrick [VBGP] (#3 Carmelita Street, San Ignacio, Cayo) to develop You/Your Business website and therefore entered this contract agreement once the project has started.
Identifying What Each Party Agreed to Do
You/Your Business agrees that Visuals by Glenn Patrick is responsible for your website development. You will provide all information, sitemap, and feedback needed to complete the project in a timely manner to stick to the timeline agreed on. If either party is behind, we communicate our setbacks as soon as possible and adjust the timeline accordingly, if necessary.
Visuals by Glenn Patrick will prioritize time towards your project in order to meet the deadline agreed upon. All information given to VBGP is always kept confidential. In the case a third-party partner is required to help with additional tasks (for example content writing), you will be notified and they will be updated on client confidentiality as well.
Moving on to the Work
Initiation of Project: The project will commence once the sitemap, logos, images & content required to start are sent and the first deposit is made. Dummy text and substitute images will be used if missing content needed to complete the project is not turned in within 4 weeks (20 working days) of the project starting. If missing contents are not sent by the project deadline the client will either be required to replace them or pay an extra fee for VBGP to replace them.
Web and Product Designs: VBGP is to provide a custom design based on a WordPress template that best fits the features requested or that agreed upon by You/Your Business. Kindly note although VBGP is knowledgeable in building website with over a decade of experience, we are not programmers/coders and do not code themes or plugins from scratch.
Text Content: You/Your Business is responsible to provide all content that they want on the website. Any missing content will be filled in with “dummy” text. Your Business assures VBGP that you have the right or permission to use all text content provided and VBGP is not responsible in the case of copyright infringement.
Images and Photography: You/Your Business is responsible to provide all images you want on the website. Your Business must ensure you have the right to use these images on the website. VBGP will look up and provide images from online for the project where applicable.
Web Graphics: VBGP will create web graphics (banners & buttons) with images sent or look up images online for designs where applicable.
The browser and Mobile Testing: In the testing and reviewing period of the website Your Business is expected to test the website on all popular browsers (Chrome, Firefox, Safari, and EI) and mobile (iPhone & Samsung). Keep in mind that browser testing no longer means that the website will be exactly the same on all browsers but rather the browsing experience is appropriate as each browser has its own settings and capabilities.
Website Support: VBGP will be available for support with basic coding, text content, and images a week (5 working days) after the launch of the website before website support fees are required.
Search engine optimization (SEO): SEO is a separate service that is optional but recommended. If you agree to have VBGP add SEO to your website you understand that it does not guarantee improvement to your website ranking on search engines right away. It takes 3 to 6 months at minimum to start ranking on Google. It will also take work on You/Your Business’ part even after the SEO is done because of the nature of SEO and search engines. Please ask about our rates if necessary.
Website Security: If You/Your Business is not under a hosting plan with VBGP you are solely responsible for the security of your websites. This includes, but is not limited to, keeping all passwords secured, keeping WordPress and plugins updated, and backing up your website. You can choose to do this on your own if you have the know how, by hiring VBGP or hiring someone who is qualified in these areas.
If you are under one of our hosting plans then we assume the responsibility for your website’s security depending on the plan you choose. We will put all measures in place to keep it protected. With that said, it is important to note that even so things can go wrong. Hackers and users with malicious intent are constantly evolving their tactics to cause harm. In any such case, you understand that VBGP will do all that is necessary to keep you secure and /or get your website back up as soon as possible. You agree not to use it as an opportunity to cause problems between You/Your Business and VBGP in any way, shape, or form, but rather work with us to resolve the issue as smoothly as possible.
Intellectual Property Rights: Provided that the content and images sent in are yours or you have permission to use them, you agree to protect us from any claim by a third party that we’re using their intellectual property. VBGP assures you that we have permission to use any content or images that we used on your website. You also keep all rights to content associated with the project.
eCommerce/ Booking/ Tour Websites
VBGP’s eCommerce website package comes with the basic setup of the the online store plugin (WooCommerce). This includes everything you need to start an online store:
- Installation and setup of plugin
- Setup store address
- Add main currency setup (1)
- Add product categories
- Setup store page – display products and basic category selection
- Add product pages – description, category, product images, reviews and related products
- Set up cart, checkout and account pages
- Setup payment gateways – in cash, bank deposit (external link) and/or PayPal (PayPal requires a business account that is already verified.)
- Setup shipping – flat rate, free shipping or/or local pickup
- Add inventory
- Allow customer to create an account or place order without one
- Setup basic emails for orders
Building an eCommerce website can become complex depending on your needs. Some features require the setup of add-on plugins that are not apart of the initial set-up and may cost extra. Defining exactly what you need helps with giving the right estimate at the start of the project and helps avoid additional fees later on when additional features outside the initial setup are requested. Please feel free to ask for clarification where needed.
This general apply to Booking and Tour websites as well.
Ownership (Domain and Website)
You/Your Company is the owner of the domain and website files once your project is completed and paid for in full. If you are hosting with VBGP, you can then request all access information to your website after completion. This information can be used to access the backend of the website in order to make changes, download your website files, or transfer your website. VBGP manages your domain and hosting and the fee is included in the yearly renewal. If you would like to manage your own domain and/or hosting at any point, please contact me for more information.
In the case that your website expands and becomes resource heavy for our servers we will let you know and discuss what options are available.
Please note that if at any point VBGP is unable to offer hosting or domain registration services, you will be notified and we will work to figure out how to transfer your website and domain to another provider or to your control. A service fee may be required if you need technical support from VBGP to complete certain requests.
Project Timeline
Timeline for website projects is set for 4 to 8 weeks. In many cases we are able to complete the project earlier once all images and content are submitted in a timely manner.
Other Important Information
- Please keep in mind that we do build and customize websites based on existing themes/templates and do not create them by coding or from scratch. If custom coding is required to achieve a feature on any theme used to complete your project (which is rarely the case) we may need to add additional charges and/or hire a coder.
- VBGP will do the research to provide and provide the best options for features requested for your website project (whether that solution can be done in-house or by a third party). We will proceed with the options that work best with your approval.
- VBGP is experienced and has the capability to design & create a fully functioning website and will not be responsible for any damages caused to the website after it is tested, approved, and launched. Be sure to follow instructions or hire a professional to avoid damaging your website in any form.
- Building a website is an essential first step but the success of your website to bring in profit is the sole responsibility of you, the client, through marketing, online ads, SEO, and any other means you see fit.
Custom Package Pricing
Kindly note VBGP offers discounted pricing based on how many pages and features are requested. In other words the more pages and features requested the better the deal is. If you decide to change the amount of pages and/or features initially requested, this may affect the discounted price initially offered for your custom package.
Payment Agreement
A 50% deposit is required before the project can be started. Then 25% deposit at the review stage and the final 25% deposit before the site is launched. We do accept a final deposit of 50% before that launch of the project if that work for you.
If You/Your Business fails to hand in missing content and images in time to meet deadlines you agree to compensate VBGP on time for the work done and completing our part of the project by the deadline date. You can then choose to pay a support fee for VBGP to add correct content or hire a website developer.
Cancellation of Project
If You/Your Business decides to terminate the website project, at any time, you are responsible to pay for the amount of work/time already place in by VBGP at the point of cancelation. This is whether it’s giving back a full refund, a partial refund, no refund, or you owing additional service fees. Kindly note that a 6% government business tax will be deducted from the deposited amount if VBGP monthly taxes have been paid on said amount at the point of cancelation.
Interest Rates
If an invoice payment is missed a 3% late fee will be charged on the remaining balance for each month that is missed.
Third Party Vendors
If you use a third-party vendor beware that their policies may vary from VBGP’s and we are not liable for any issues you may have with them. VBGP is not responsible for any issues with any third-party services.
Refusal of Service
Visuals by Glenn Patrick does not promote hate, intolerance, pornography, animal exploitation, or any other unethical practice. VBGP reserves the right to decline to do business with any client for any reason.
Portfolio and Footer Credits
Visuals by Glenn Patrick adds a site credits link/page to your website. This is common practice and is a prominent source of advertisement. We do reserve the right to display that we design and develop your website in our portfolio. If you for some reason you prefer us not to, a fee of $500BZD will be required to have it removed from our portfolio.
